Privacy Policy and Disclosures

This Privacy Policy describes how Atmosphere Press, LLC, 5000 Plaza on the Lake, Ste. 100 #416, Austin, TX 78746 (“Atmosphere Press,” “we,” “us,” or “our”) collects, uses, and shares information in connection with the website atmospherepress.com and the tools, forms, and e-commerce functionality available through it (the “Service”). This Privacy Policy replaces all prior versions. Disputes arising under this Privacy Policy are governed by the Dispute Resolution provisions of our Terms of Service, as described in Section 9 below.

1. Information You Provide to Us

We collect information you voluntarily provide, including: contact information (name, email address, phone number, postal address) submitted through contact, newsletter, giveaway, or inquiry forms; manuscripts and related materials you submit for editorial consideration; information you provide when purchasing services or products, excluding full payment card details, which are collected and processed by our payment processors; information you provide through our chat widget; and the contents of communications you send us.

2. Information Collected Automatically: Tracking Technologies

The Service uses cookies and tracking technologies provided by third parties to enable analytics, advertising, attribution, session recording, form handling, security, and related functionality. The technologies in current use include the following:

  • Tag management: Google Tag Manager (Google LLC), which deploys and manages the tags described below.

  • Analytics: Mixpanel (Mixpanel, Inc.); HubSpot analytics (HubSpot, Inc.); and WordPress.com / Jetpack site statistics (Automattic Inc.).

  • Advertising and attribution: Google Ads conversion tracking and remarketing (Google LLC, including the DoubleClick advertising network); Microsoft Advertising Universal Event Tracking (Microsoft Corporation); and the HubSpot advertising pixel (HubSpot, Inc.).

  • Session recording, replay, and heat-mapping: Mixpanel Session Replay (Mixpanel, Inc.); Microsoft Clarity (Microsoft Corporation); and Crazy Egg (Crazy Egg, Inc.). These tools record information about how visitors interact with pages on the Service, which may include mouse movements, clicks, scrolling, page navigation, and interactions with on-page elements and forms, in order to help us understand and improve how the Service is used.

  • Forms, chat, and customer-relationship management: HubSpot forms and form-collection tools, which capture the information you enter into forms on the Service; the HubSpot chat/messaging widget, which captures chat conversations; and the HubSpot customer-relationship platform, in which we store contact records. Emails we send through HubSpot contain tracking pixels and tracked links that tell us whether an email was opened and whether links were clicked.

  • Security: Google reCAPTCHA Enterprise (Google LLC), which protects our forms from automated abuse and which collects hardware and software information, such as device and application data, and sends it to Google for analysis. Use of reCAPTCHA is subject to the Google Privacy Policy (https://policies.google.com/privacy) and Terms of Service (https://policies.google.com/terms).

  • Embedded third-party content: Trustpilot review widgets (Trustpilot A/S); Elfsight widgets (Elfsight LLC); Loom embedded video (Loom, Inc.); Google Fonts (Google LLC); and Gravatar profile images (Automattic Inc.). When a page containing embedded third-party content loads, the third party may receive your IP address and information about the page you are visiting.

These technologies may collect information about your interactions with the Service, including pages viewed, navigation patterns, click and scroll events, form interactions, device and browser information, IP address, approximate location derived from IP address, and referrer information. Data collected by these technologies is transmitted to and processed by the third-party providers listed above, in some cases on servers located outside your country of residence.

Consent through use (United States). If you are located in the United States: by accessing the Service and continuing to use it, you acknowledge and consent to the use of the tracking technologies described in this Section and to the collection, transmission, and processing of data as described in this Privacy Policy. If you do not consent, do not use the Service. If you are located outside the United States, see Section 11.

Opt-outs. You may control or limit certain tracking through: standard browser controls, including cookie blocking, private browsing, and tracker-blocking extensions; Google’s ads settings (https://adssettings.google.com) and Google Analytics/advertising opt-out tools; Microsoft’s opt-out controls (https://account.microsoft.com/privacy/ad-settings); Mixpanel’s opt-out described in its privacy policy (https://mixpanel.com/legal/privacy-policy); Crazy Egg’s opt-out (https://www.crazyegg.com/opt-out); and the Global Privacy Control browser signal, which we honor where required by applicable law. Limiting optional tracking does not affect your ability to use the Service.

3. How We Use Information

We use the information described above to: respond to inquiries and manuscript submissions; provide, operate, and improve the Service and our publishing services; process purchases; send marketing and informational communications, which you may opt out of at any time; measure the performance of our advertising; secure the Service against fraud and abuse; and comply with legal obligations.

4. How We Share Information

We do not sell your personal information for money. We share information with: the service providers identified in Section 2, which process data on our behalf or, in the case of advertising providers, for ad measurement and remarketing; fulfillment partners, such as Bookshop.org, as necessary to fulfill orders; professional advisers and authorities where required by law; and a successor entity in connection with a merger, acquisition, or sale of assets. Our use of third-party advertising and analytics technologies may constitute “sharing” of personal information, or “targeted advertising,” as those terms are defined under certain U.S. state privacy laws; Section 10 describes how to opt out.

5. Payment Security

Payment card information submitted through the Service is encrypted in transit and processed by third-party payment processors. We do not store full payment card numbers on our servers. We also take precautions to protect your information offline: access to personally identifiable information is limited to personnel who need it to perform a specific job, and the systems in which we store personally identifiable information are kept in a secure environment.

6. Data Retention

We retain personal information for as long as needed for the purposes described in this Privacy Policy, including maintaining our relationship with you, complying with legal obligations, resolving disputes, and enforcing agreements. Manuscript submissions that do not lead to publication are retained for our editorial records unless you request deletion.

7. Your Access to and Control Over Information

You may opt out of marketing communications at any time. You may also, at any time, contact us using the information in Section 14 to: see what data we have about you, if any; change or correct data we have about you; request that we delete data we have about you; or express any concern you have about our use of your data.

8. Children

The Service is not directed to children under 13, and we do not knowingly collect personal information from children under 13. If you believe a child has provided us personal information, contact us and we will delete it.

9. Disputes Regarding Data Handling

Any dispute, claim, or controversy arising under or relating to the collection, use, sharing, processing, or retention of data under this Privacy Policy is governed by the Dispute Resolution provisions of our Terms of Service, including the pre-dispute notice requirements, informal resolution requirements, arbitration agreement, class-action waiver, governing law, and venue set forth there. By using the Service, you agree that any such dispute will proceed in accordance with those provisions and will not be brought as a class, collective, consolidated, or representative action.

10. Substantiation of Data-Handling Claims

If you believe your data has been collected, used, shared, or processed in violation of this Privacy Policy or applicable law, you must provide us with all of the following as part of your pre-dispute notice under the Terms of Service:

  1. a complete, unedited copy of the data forming the basis of your claim;

  2. a detailed written explanation specifying the nature of the alleged violation, the date or dates on which it occurred, the URLs accessed, the device and browser used, and the IP address or addresses used to access the Service, if known;

  3. the legal theory or theories on which the claim is based; and

  4. a description of the harm alleged.

This requirement is intended to enable a meaningful investigation of any alleged violation and shall not be construed to limit any rights you have under applicable law.

11. U.S. State Privacy Rights

Depending on your state of residence, you may have rights under state privacy law, including the right to know or access the personal information we hold about you, the right to correct it, the right to delete it, the right to obtain a portable copy, and the right to opt out of the “sale” or “sharing” of personal information or of “targeted advertising.” To exercise any of these rights, contact us using the information in Section 14, or use the opt-out mechanisms described in Section 2, including the Global Privacy Control signal. We will not discriminate against you for exercising any of these rights. We may need to verify your identity before fulfilling a request, and you may designate an authorized agent to act on your behalf as permitted by applicable law.

12. International Users

The Service is operated from the United States, and information collected through the Service is processed and stored in the United States and in other jurisdictions where our service providers operate. If you access the Service from outside the United States, you understand that your information will be transferred to and processed in the United States. If the law of your jurisdiction — including the European Economic Area, the United Kingdom, or Australia — grants you additional rights regarding your personal information, such as rights of access, rectification, erasure, restriction, portability, or objection, or the right to lodge a complaint with a supervisory authority, you may exercise those rights by contacting us using the information in Section 14, and nothing in this Privacy Policy limits any such non-waivable rights. The consent-through-use provision in Section 2 applies only to users located in the United States.

13. Affiliate Disclosure

Atmosphere Press books are fulfilled by Bookshop.org, and Atmosphere Press earns a commission from Bookshop.org if you click through and make a purchase.

Material changes will be indicated by updating that date and posting the revised policy on the Service. We review the tracking-technology disclosure in Section 2 periodically to keep it accurate and current.
